Summary
Deriv, formerly Binary.com, serves EU clients through a Maltese investment firm and holds licences in the UAE, Mauritius, the British Virgin Islands and Vanuatu, but its terms place its core options and multipliers for other clients with a Samoa company, and some MT5 accounts with a St Vincent company, neither of which states a financial licence. No enforcement action against Deriv or Binary.com companies was found at the sources searched; the Bank of Russia added the group to its warning list in 2021. Its Cyprus operation is Great Place to Work certified and on the 2025 Best Workplaces in Cyprus list.

Findings
Regulation & Licensing
44/100Licences in Malta, the UAE, Mauritius, the British Virgin Islands and Vanuatu were confirmed on the regulators’ registers; Cayman and Labuan licences are stated by Deriv. Deriv’s non-EU terms allocate options and multipliers on Deriv Trader and Deriv Bot to Deriv Capital International Ltd in Samoa and standard MT5 CFDs to Deriv (SVG) LLC, and Deriv states no financial licence for either.
- StrengthDeriv Investments (Europe) Limited (C 70156) has held an MFSA investment firm licence since 19 May 2015, covering dealing on own account and executing orders for retail clients, and passports its services to the EEA.
- StrengthDeriv Capital Contracts & Currencies L.L.C is listed as active on the UAE Capital Market Authority’s register; Deriv (Mauritius) Ltd has been licensed by the FSC Mauritius as an investment dealer since 14 June 2024; Deriv (BVI) Ltd is listed by the BVI FSC for dealing as agent and as principal; and Deriv (V) Ltd is listed by the Vanuatu Financial Services Commission as an active financial dealer.
- HighDeriv’s general terms for non-EU clients state that accounts for options and multipliers on Deriv Trader and Deriv Bot are linked to Deriv Capital International Ltd, a company incorporated in Samoa, and that standard and swap-free MT5 CFDs may be linked to Deriv (SVG) LLC in St Vincent and the Grenadines. Deriv states no financial licence for either company, and the Samoa company does not appear on its regulatory information page.
- LowThe document Deriv links as the licence of Deriv (FX) Ltd is a Labuan certificate recording its change of name to Deriv Investment Bank (Labuan) Ltd on 4 December 2025; Deriv’s pages still use the old name. We could not check the Labuan or Cayman licences on the regulators’ registers.
- ObservationThe Financial Services Authority of Seychelles lists Deriv (Seychelles) Ltd as a securities dealer, with deriv.com as its website. Deriv does not name this company on its regulatory page or in its terms.
Corporate Structure & Ownership
68/100The group is privately held. Deriv names its holding company, Deriv.com Limited in Guernsey, and its contracting companies; GLEIF records Deriv Group SEZC in the Cayman Islands as their parent, and Companies House names founder Jean-Yves Sireau as controlling its UK company. No audited group accounts were found.
- StrengthGLEIF records Deriv.com Limited under its former names Binary Limited and Regent Markets Group Limited, and records Deriv Group SEZC as the direct and ultimate parent of Deriv.com Limited, Deriv (SVG) LLC and the Labuan company. Companies House lists Jean-Yves Christian Sireau as holding 75% or more of Deriv (UK) Limited, another subsidiary of Deriv Group SEZC, since 11 June 2020.
- ObservationNo audited accounts were found for the group or for its offshore companies. The UK company files unaudited abridged accounts.
Client Money & Payouts
45/100EU clients may be covered by Malta’s Investor Compensation Scheme, and Deriv commits to segregating their money and to negative balance protection. Deriv’s non-EU terms contain no client money segregation commitment and make negative balance protection discretionary, and part of the non-EU business is held by companies that no financial regulator supervises.
- StrengthDeriv Investments (Europe) Limited states that it participates in the Malta Investor Compensation Scheme, holds client money in segregated accounts under MFSA rules and offers negative balance protection to retail clients.
- HighDeriv’s non-EU general terms state that negative balance protection may be offered at its sole discretion and that it is not obliged to provide it. We found no commitment to segregate client money and no compensation scheme in the non-EU terms, and the Samoa and St Vincent companies hold no stated financial licence.
Execution & Pricing
Not assessed in a desk audit. Spreads, slippage and fill quality can only be measured with live accounts.
Conduct & Disclosure
88/100No enforcement action against Deriv or Binary.com companies was found in the regulator records searched, in the last eight years or earlier. The Bank of Russia added Deriv and former Binary companies to its warning list in 2021, which is recorded but not scored.
- StrengthNo enforcement action naming Deriv, Binary.com or their companies was found in the records of the MFSA, CySEC, the UK Gambling Commission, the Labuan FSA, the BVI FSC, the Financial Services Authority of Seychelles, the FSCA, the Ontario Capital Markets Tribunal, Brazil’s CVM or Japan’s FFAJ and SESC. The MFSA and FIAU penalty lists could only be partly searched.
- ObservationOn 1 February 2021 the Bank of Russia added Deriv (FX) Ltd, Deriv (V) Ltd, Binary (V) Ltd, Binary (SVG) Ltd, Deriv (BVI) Ltd, Deriv (SVG) LLC and Deriv Capital, with deriv.com, to its list of companies showing signs of illegal activity as a securities market participant. Such lists name many licensed groups; under our methodology this is recorded but not scored.
Operational Resilience
Not assessed in a desk audit. Uptime, incident history and security controls require evidence from the firm or live monitoring.
People & Community
80/100Deriv Operations (Cyprus) Ltd is Great Place to Work certified and appears on the Best Workplaces in Cyprus 2025 list. Deriv reports community projects with named partners in Paraguay, Malta, Malaysia and Rwanda.
- StrengthGreat Place to Work Cyprus lists Deriv Operations (Cyprus) Ltd among its certified companies (profile updated January 2025), and its Best Workplaces in Cyprus 2025 list includes Deriv in the 20 to 49 employee category.
- ObservationDeriv reports that in 2024 it partnered with TECHO in Paraguay to build 10 homes, supported children with cancer through Puttinu Cares in Malta, improved facilities for special needs students at SK Pantai in Malaysia and worked with DuHope in Rwanda on women’s vocational training. These are reported by Deriv itself; we found no independent reporting.

Evidence and scope
Scope
Desk audit of the group’s client-facing entities, using public sources only: regulator registers and announcements, court and company filings, and the firm’s own published documents, as available on 10 October 2026. No accounts were opened, nothing was tested live, and the firm was not asked for evidence.
Limitations
Absence of a public enforcement record is not evidence of good conduct. The MFSA and FIAU penalty lists could only be partly searched, and the Malta Gaming Authority and Isle of Man Gambling Supervision Commission, which licensed Binary.com’s former gaming companies, were not searched directly. The Labuan and Cayman licences are taken from Deriv’s disclosures, and we found nothing showing whether the Samoa company holds a licence. Non-EU pages were read through Deriv’s documents because its website served EU pages from our location. The share of clients served by each company could not be measured from public sources.
